Personal Data Administrator

The personal data Administrator is ADVISER Armknecht i Partnerzy, Radcowie Prawni sp.k. (ADVISER Armknecht & Partners attorneys-at-law) with its seat in Gdynia, at the following address: 815 Generała J. Bema Street, suite 3, Gdynia, 81386 – POLAND, NIP: 586-229-51-83 ("ADVISER" / "Administrator"), the Administrator can be contacted in writing by traditional mail or via e-mail: office@adviser.law

Purpose of websites

The website https://adviser.law/ (website) is used to provide general information about our company, the services we provide, and our employees. We also have other dedicated websites for clients and associates: www.adviser.gdynia.pl, www.adviser.law, www.armknecht.pl, www.kanzlei.com, www.radcaprawnygdynia.pl, www.kancelariaprawna.gdynia.pl, www.adviser1989.com to explain to clients issues in various areas of law and to facilitate contact with us.

Collection and processing of data

All the above-mentioned websites collect the following data: user's IP address, domain name, browser type, operating system type, visited pages, and previous and next visited website.

The data is used to generate statistics, improve the functionality of websites, manage websites by removing any technical defects, improve accessibility to certain parts of the website, and ensure the security of IT systems. Data is stored for 10 days unless otherwise indicated.

The administrator does not make automated decisions for persons whose data concerns, including decisions resulting from profiling.

The data collected while visiting the websites may be transferred to the hosting service provider (as a processor). The hosting operator is OVH sp. z o.o., operating at www.ovh.pl

Data processing period

User data is stored for a period corresponding to the life cycle of cookies stored on devices or until they are deleted by the user on their device.

Voluntary consent to the processing

Providing personal data is voluntary and is a condition for using the Administrator's websites. You can withdraw your consent to the processing of your personal data at any time. Withdrawal of consent does not affect the lawfulness of the processing carried out earlier. The consent may be withdrawn by sending an e-mail to the following address: office@adviser.law

Provision of personal data

Personal data may be transferred:

  • to entities providing technical and IT services to the Administrator;
  • to state authorities, such as the Police, the prosecutor's office, the court, PUODO, and the President of the Office of Competition and Consumer Protection, if they are entitled to do so and make such a request.

Personal data will not be transferred outside the European Economic Area (EEA).

Rights in the field of personal data processing

The User has the right to:

  • to access data;
  • to rectify (correct) data;
  • to request the deletion of data;
  • to limit data processing;
  • data portability;
  • to object to the processing of data in special situations.

 

Requests should be submitted to the e-mail address kancelaria@adviser.gdynia.pl. On the terms set out in the content of Art. 12 GDPR, the Administrator, without undue delay, but no later than within one month from the date of delivery of the inquiry or request, provides information about the actions taken in connection with the possible exercise of the rights referred to above.

 

The user also has the right to lodge a complaint with the supervisory body, which is the President of the Office for Personal Data Protection - ul. Stawki 2, 00-193 Warsaw.

 

Cookies

The Administrator of the website https://www.adviser.law uses the so-called cookies. Cookies are small files that are saved in the memory of the user's device (computer, telephone, etc.). Cookies have been placed in order to allow the user to use all the functionalities of the pages maintained by the Administrator. These files allow to identify the software used by the user and adapt the website to the individual needs of the user.

We use two types of cookies:

  • session cookies: they are stored on the device and remain on it until the end of the browser session. The information is then permanently deleted from the user's device memory. They do not allow the collection of personal data or other confidential information from the user's device.
  • persistent cookies: they are stored on the device and remain on it until they are deleted. Ending a browser session or turning off the device does not delete them from your device. The persistent cookies mechanism does not allow the collection of any personal data or any confidential information from your device.

 

We also use "cookies" of external entities for the following purposes:

  1. creating statistics that help to understand how users use websites, which allows for improving their structure and content through Piwik analytical tools, the administrator of which is Piwik PRO S.A., Piwik's privacy policy is available at the following links: https://piwik.pro/privacy-policy/;
  2. facilitating contact and recognizing the needs of users by means of the social network Facebook.com, the administrator of which is Facebook Inc. based in the USA or Facebook Ireland based in Ireland, the Facebook Privacy Policy is available at the following link: Facebook;
  3. facilitating contact and recognizing the needs of users using the linkedin.com social network, the administrator of which is LinkedIn Ireland Unlimited Company based in Ireland, the linkedin.com privacy policy is available at the following link: LinkedIn;
  4. facilitating contact and recognizing the needs of users by means of the twitter.com social network, the administrator of which is Twitter Inc. based in the USA, the twitter.com Privacy Policy is available at the following link: Twitter.

 

Cookies contain the name of the domain they come from, the storage time on the device, and the assigned value. They do not change the device settings, and by using the appropriate browser options, the user can remove or block them at any time. It is not possible for viruses and other unwanted software or malware to pass through them.

 

Provision of legal services and data protection

ADVISER when providing legal assistance to clients, processes personal data of various categories of persons. These include clients, clients' contact persons, attorneys-at-law, legal advisers, tax advisers, notaries public, bailiffs, employees of administrative bodies, courts, prosecutor's offices, witnesses, experts, contractors, contractors' contact persons, contractor advisers, and other persons whose personal data are part of Act.

Creation of personal data files and their processing

Before starting the service, we collect personal data in order to verify the client's identity and determine whether there is a risk of a conflict of interest between our clients or a breach of other ethical principles.

When conducting court disputes on behalf of clients, negotiating contracts, and providing other legal services, we create sets of personal data based on the data provided to us by clients, and then we search for relevant information. We use this information in documents prepared by us as part of the services we provide, i.e. pleadings, pre-trial letters, contracts, reports, and corporate documents. We carry out these activities in order to effectively provide services.

This processing is carried out on the basis of the legitimate interest of our clients to establish, investigate, satisfy, secure claims and defend their rights. We also process some of the above-mentioned personal data for internal know-how purposes. We store the files (after deleting most of the personal data in an internal know-how repository to retrieve this information at a later date.

We also use the contact details including the name and surname, address, and e-mail address of our clients and their representatives/attorneys/guardians/curators to issue and send invoices. We perform these activities to collect service fees as part of the performance of contracts with customers

Data storage

We store personal data in order to enable the District Chamber of Legal Counsels in Gdańsk and the National Chamber of Legal Counsels to control compliance with the rules of practicing the profession, to which we are legally obliged.

We store files for the period of limitation of any claims that may arise as a result of providing legal assistance and other circumstances related to the service provided. After this period, we safely shred all files.

At the client's express request, we provide information processed in the course of the provision of services, including legal counsels, lawyers, tax advisers, other client advisors, administrative authorities, courts, and the prosecutor's office.

Protection of personal data

ADVISER applies information security measures both in the office through the physical protection of access to documents and electronic security of access to data. Electronic means include double encryption of desktops, laptops, and phones, network segmentation, virus scanners, traffic monitoring, and single USB stick encryption. Organizational measures include a clear control policy, confidentiality policy, personnel screening, training, privacy, and security awareness-raising, and the implementation of supplier contract controls.

 

 

This Privacy Policy (version 1.0 of 31/01/2022) was adopted by the partners of the Law Office on 31 January 2022 and is effective as a resolution.
