Faktury ustrukturyzowane- dobra wiadomość czy nowy kłopot przedsiębiorcy?

Obecnie w Sejmie prowadzone są prace legislacyjne nad projektem ustawy o zmianie ustawy o podatku od towarów i usług oraz niektórych innych ustaw. Projekt ten wprowadza nowy rodzaj faktury tzw. fakturę ustrukturyzowaną.

 

Czym będzie faktura ustrukturyzowana?

Faktura ustrukturyzowana ma być jedną z dopuszczanych form dokumentowania sprzedaży obok faktur papierowych i obecnie występujących w obrocie gospodarczym faktur elektronicznych, których wprowadzenie mimo niekwestionowanych zalet powodowało liczne problemy techniczne jak i prawne. Przedsiębiorcy korzystający z różnych programów informatycznych nie zawsze byli w stanie odczytać fakturę elektroniczną. Pojawiały się też opłaty za wystawienie i dostarczenie kontrahentowi faktury w formie papierowej co budziło wątpliwości natury prawnej. Twórcy projektu przewidzieli możliwości wystawiania i otrzymywania faktur ustrukturyzowanych za pośrednictwem systemu teleinformatycznego, tj. Krajowego Systemu e-Faktur (KSeF).

Czy stosowanie faktur ustrukturyzowanych będzie obowiązkowe?

Stosowanie faktur ustrukturyzowanych będzie miało charakter fakultatywny, tak więc to od decyzji przedsiębiorcy zależeć będzie czy taką fakturę wystawi czy pozostanie przy fakturze w formie papierowej lub zwyklej fakturze elektronicznej. Co ważne stosowanie faktur ustrukturyzowanych będzie wymagało akceptacji odbiorcy takiej faktury.

Jaki skutek ma dla przedsiębiorcy nowelizacja ustawy o VAT?

Podatnicy wystawiający faktury ustrukturyzowane za pośrednictwem KSeF zostaną zwolnieni z obowiązku ich przechowywania i archiwizacji. W KSeF to administracja podatkowa zapewni przechowywanie wystawionych za jego pośrednictwem faktur. Ponadto dla podatników wystawiających w całym okresie rozliczeniowym wyłącznie faktury ustrukturyzowane będzie istniała możliwość skrócenia terminu zwrotu podatki VAT z 60 dni do 45 dni. Ponadto projekt ustawy przewiduje możliwość zwolnienia podatników z obowiązku przesyłania na żądanie organów podatkowych „Jednolitego Pliku Kontrolnego dla Faktur (JPK_FA)” w zakresie obejmującym faktury ustrukturyzowane.

 

Kiedy nowe przepisy wejdą w życie?

Przewidywany termin to 1 października 2021.

Podsumowanie

Wprowadzenie faktur ustrukturyzowanych może przynieść przedsiębiorcom wiele korzyści. W początkowej fazie będzie konieczność zapoznania się z systemem KSeF oraz uzyskania od kontrahentów zgody na wystawianie i doręczanie faktur za jego pomocą, niemej jednak wydaje się że korzyści płynące z nowego rodzaju faktury są warte podjęcia tego wysiłku. Faktura ustrukturyzowana pozwoli na znaczne zmniejszenie kosztów przedsiębiorcy związanych zarówno z wystawianiem, doręczaniem i archiwizacją dokumentów jak również ograniczy w przyszłości problemy techniczne z jej odtworzeniem przez kontrahenta.
