Dyrektywa Omnibus Konsumencie czy wiesz jakie otrzymasz prawa?

Obowiązki dostawcy platformy handlowej  

 

Dostawca internetowej platformy handlowej będzie miał obowiązek poinformować konsumenta przed zawarciem umowy na odległość o:

 

1.      wcześniejszej cenie, jeśli wprowadza obniżkę tj. najniższej stosowanej cenie w ciągu 30 dni przed obniżką,

2.      tym czy osoba trzecia oferująca na jego platformie handlowej towary, usługi lub treści cyfrowe jest przedsiębiorcą

3.      w przypadku gdy osoba trzecia oferująca na platformie handlowej towary, usługi lub treści cyfrowe nie jest przedsiębiorcą–informację o tym, że prawa konsumentów wynikające z unijnego prawa ochrony konsumentów nie mają zastosowania do umowy,

4.      sposobie, w jaki obowiązki związane z umową są podzielone pomiędzy osobę trzecią oferującą  na platformie handlowej towary, usługi lub treści cyfrowe a dostawcę internetowej platformy handlowej.

 

Ponadto przedsiębiorca musi powstrzymać się od wykorzystywania treści innych niż dane osobowe, które zostały dostarczone lub wytworzone przez konsumenta w trakcie korzystania z treści cyfrowych lub usługi cyfrowej. W odniesieniu do danych osobowych konsumenta, przedsiębiorca  będzie musiał wykonywać obowiązki wynikające z RODO.

Internetowy punkt kontaktowy

Komisja zapewniła, by obywatele poszukujący informacji na temat przysługujących im praw konsumentów oraz pozasądo­wych sposobów rozstrzygania sporów, mogli korzystać z internetowego punktu kontaktowego, za pośrednictwem jednolitego portalu cyfrowego. Portal umożliwia im:

1.       dostęp do aktualnych informacji na temat obowiązujących w Unii praw konsumentów,

2.       złożenie skargi za pośrednictwem platformy internetowego rozstrzygania sporów oraz do właściwego centrum należącego do Sieci Europejskich Cen­trów Konsumenckich, zależnia od zaangażowanych stron.

Sankcje  

 

Państwa członkowskie mają zapewnić możliwość nakładania grzywny za nieprzestrzeganie Dyrektywy Omnibus. Kara ma być nakładana w postępowaniach administracyjnych albo sądowych. Maksymalna wysokość grzy­wny musi stanowić co najmniej 4 % rocznego obrotu przedsiębiorcy. W przypadku gdy informacje o rocznym obrocie przedsiębiorcy nie są dostępne, państwa członkowskie wprowadzają przepisy przewidujące możliwość nakładania grzywny, której mak­symalna wysokość wynosi co najmniej 2 mln EUR.
