Od ogłoszenia do obowiązywania - krótki słownik pojęć

OGŁOSZENIE – akty normatywne to każdy tekst – akt organu państwa, który zawiera normy postępowania wydany na podstawie uprawnień przyznanych przez Konstytucję albo ustawę, skierowany do konkretnych adresatów. Rozróżniamy akty normatywne powszechnie obowiązujące, czyli takie, które są skierowane do ogółu ludzi (zasadniczo skierowane są do wszystkich osób, przebywających na terenie Polski), akty prawa miejscowego (skierowane do wszystkich osób, przebywających na terenie danego obszaru w kraju, np. gminy) oraz akty prawa wewnętrznie obowiązujące (skierowane do konkretnej grupy podmiotów podległych organowi państwa – takim aktem są między innymi uchwały Sejmu i Senatu).
Akty normatywne powszechnie obowiązujące nie mogą wejść w życie bez ich ogłoszenia i są one ogłaszane w Dzienniku Ustaw. Akty wewnętrzne ogłaszane są w Monitorze Polskim. Oprócz tych dwóch dzienników urzędowych, niektóre ministerstwa prowadzą swoje własne dzienniki urzędowe.

Zarówno Dziennik Ustaw, jak i Monitor Polski, dostępne są dla każdego w Internecie i są to swego rodzaju bazy polskich aktów prawnych. Dzięki Dziennikowi Ustaw każdy z nas ma możliwość śledzenia procesu legislacyjnego w kraju oraz czerpania wiedzy o zmianach w prawie. Polecamy śledzenie zmian legislacyjnych „u źródła”, za pomocą dzienników lub systemów informacji prawnej, takich jak Lex.pl od Wolters Kluwer PL. W ten sposób jesteśmy w stanie uzyskać rzetelną i kompletną informację.

OPUBLIKOWANIE – akty są ogłaszane przez ich opublikowanie w w/w dziennikach urzędowych. Ponieważ od 2012r. dzienniki urzędowe są prowadzone tylko w wersji elektronicznej (a więc internetowej) oznacza to, że „opublikowanie” oznacza de facto wstawienie danego aktu do internetowego dziennika urzędowego. Pojawienie się aktu prawnego w danym dzienniku jest równoważne z jego ogłoszeniem.
WEJŚCIE W ŻYCIE – termin wejścia w życie związany jest bezpośrednio z pojęciem „vacatio legis” (łac. próżnowanie ustawy), tj. okresem pomiędzy publikacją danego aktu normatywnego w dzienniku urzędowym a jego wejściem w życie. Dzień z którym dany akt normatywny wchodzi w życie jest jednocześnie pierwszym dniem jego obowiązywania. Głównym celem vacatio legis jest umożliwienie adresatom zapoznanie się ze zmianami w przepisach i przygotowanie się do nowych okoliczności prawnych, które wiążą się z ich wejściem w życie.
OBOWIĄZYWANIE („OBOWIĄZUJE OD/DO”) – okres w którym dany akt prawny obowiązuje (od dnia … do dnia …) oznacza tyle, że w okresie tym posiada moc obowiązującą (wiążącą). Akt zyskuje moc obowiązującą z dniem jego ogłoszenia. Jeśli uznajemy, że dany akt jest obowiązujący, oznacza to, że nie został on uchylony. Posiadanie przez ten akt prawny mocy obowiązującej oznacza, że normy prawne w nim zawarte wiążą ich adresatów. Potocznie można powiedzieć, że to, że dany akt obowiązuje oznacza, że jest on dla nas „ważny”/”aktualny” – czegoś nam zakazuje, nakazuje, reguluje nasze stosunki społeczne (w tym sposoby, tryb zawierania między sobą umów), gospodarcze, etc.
Zgodnie z przewodnikiem praktycznym Parlamentu Europejskiego, Rady i Komisji przeznaczonym dla osób redagującym akty prawne w Unii Europejskiej [1] akty prawne muszą być:jasne, zrozumiałe i jednoznaczne,
proste i zwięzłe, bez niepotrzebnych elementów,
precyzyjne, niepozostawiające u odbiorcy wątpliwości.
