[Prawo morskie] Zdatność do żeglugi i dobra praktyka morska – obowiązki kapitana statku w związku z podróżą morską | kancelaria radców prawnych ADVISER Gdynia - Gdańsk

Odpowiedzialność kapitana statku zgodnie z treścią art. 56–57 ustawy z dnia 18 września 2001 r. - Kodeks morski (Dz. U. z 2023 r., poz. 1309 - t.j.; dalej: "k.m."), to fundament bezpieczeństwa żeglugi, który w praktyce weryfikuje się przez dokumenty bezpieczeństwa statku, wyniki inspekcji i audytów, system zarządzania bezpieczeństwem (ISM - International Safety Management Code - Międzynarodowy kodeks zarządzania bezpieczną eksploatacją statków i zapobieganiem zanieczyszczaniu - przyjęty przez IMO) oraz reakcję na zdarzenia i ryzyka.

Artykuł 56 k.m. wprowadza klauzulę należytej staranności („staranność sumiennego kapitana statku") przy wszystkich czynnościach służbowych, zaś art. 57 k.m. uszczegóławia ją w kluczowym obszarze: zdatności statku do żeglugi przed rozpoczęciem i w czasie podróży morskiej.

 

Art. 56. [Dochowanie staranności sumiennego kapitana statku]
Kapitan obowiązany jest dochować staranności sumiennego kapitana statku przy wszystkich czynnościach służbowych.

Art. 57. [Odpowiedzialność kapitana statku za zdatność statku do żeglugi]
Kapitan obowiązany jest przed rozpoczęciem i w czasie podróży dołożyć należytej staranności, aby statek był zdatny do żeglugi, a w szczególności aby odpowiadał wymaganiom wynikającym z przepisów i zasad dobrej praktyki morskiej co do bezpieczeństwa, obsadzenia właściwą załogą, należytego wyposażenia i zaopatrzenia.

Staranność sumiennego kapitana statku - obiektywny standard zawodowy przy ustalaniu ewentualnej odpowiedzialności prawnej

Obowiązek dbania o zdatność do żeglugi mieści się w granicach czynności służbowych kapitana i obejmuje zarówno czynności wykonywane osobiście, jak i działania o charakterze kontroli lub nadzoru nad załogą. Komentarz do Kodeksu morskiego akcentuje obiektywny charakter miary staranności – standard zawodowy, a nie subiektywne możliwości konkretnej osoby, co ma znaczenie przy analizie zdarzeń wypadkowych i sporów z ubezpieczycielami.​

W tle pojawia się pojęcie dobrej praktyki morskiej (good seamanship), rozumianej jako rozsądne, przezorne postępowanie oparte na wiedzy i doświadczeniu oraz wymaganiach prawnych i zwyczajach. Zgodnie z doktryną dobra praktyka morska może być wykorzystywana przez orzecznictwo w trzech modelowych sytuacjach: gdy brak regulacji wprost, jako wsparcie normy prawnej lub jako skrót uzasadnienia wskazujący, jak należało postąpić w danej sprawie.

Zdatność do żeglugi - kompleksowa "checklista" kapitana statku

Artykuł 57 k.m. wskazuje, że kapitan statku obowiązany jest przed rozpoczęciem i w czasie podróży morskiej dołożyć należytej staranności, aby statek był zdatny do żeglugi, a w szczególności aby odpowiadał wymaganiom wynikającym z przepisów i zasad dobrej praktyki morskiej co do bezpieczeństwa, obsadzenia właściwą załogą, należytego wyposażenia i zaopatrzenia. Katalog wymagań nie jest zamknięty, z uwagi na użyty zwrot „w szczególności" oznacza, że zdatność do żeglugi obejmuje wszystkie aspekty wpływające na bezpieczną eksploatację statku.​

W doktrynie (zob. m.in. D. Pyć [w:] Kodeks morski. Komentarz, red. C. Łuczywek, I. Zużewicz-Wiewiórowska, Warszawa 2022, art. 56 i 57), wskazuje się, że na zdatność do żeglugi (seaworthiness) składają się: 

  • posiadanie odpowiednich dokumentów bezpieczeństwa statku,  ​
  • odpowiedni stan techniczny statku,
  • właściwą obsadę załogą (kapitan i oficerowie z odpowiednimi dyplomami, załoga ze świadectwami, liczba członków zgodna z Dokumentem minimalnej bezpiecznej obsługi),
  • odpowiednie wyposażenie oraz prawidłowy załadunek z właściwie zamocowanym ładunkiem zgodnie z art. 62 k.m.

Istotne jest, że dokumenty bezpieczeństwa stanowią dowód zgodności stanu statku w dniu inspekcji, ale nie zwalniają kapitana ani załogi z obowiązku własnej, bieżącej oceny i monitorowania zdatności statku. Inspekcje i audyty statku jako dowód należytej staranności

Standard wynikający z treści art. 56–57 k.m. weryfikuje się w praktyce przez procedury inspekcji i audytów oraz dokumentowanie działań kapitana. Rozporządzenie Ministra Gospodarki Morskiej i Żeglugi Śródlądowej z dnia 9 stycznia 2020 r. w sprawie inspekcji i audytów statku morskiego (Dz. U. z 2025 r., poz. 1296 - t.j.), m.in. w treści §26, §28 i § 30 ust. 1, przewiduje, że inspekcje i audyty są przeprowadzane na wniosek armatora lub kapitana, a statek powinien być przygotowany do sprawnego i bezpiecznego ich przeprowadzenia.

Zgodnie z § 28 rozporządzenia w sprawie inspekcji i audytów statku morskiego z przeprowadzonej inspekcji sporządza się protokół, który podpisują inspektor i kapitan statku albo osoba przez niego upoważniona. Do protokołu wpisuje się polecenia dla armatora oraz kapitana statku wydane na podstawie wyników przeprowadzonej inspekcji oraz wyznacza termin ich wykonania. Kapitan statku albo osoba przez niego upoważniona mogą, przed podpisaniem protokołu, zgłosić organowi inspekcyjnemu pisemne zastrzeżenia do ustaleń protokołu. 

Natomiast zgodnie z § 30 rozporządzenia w sprawie inspekcji i audytów statku morskiego z przeprowadzonego audytu sporządza się raport, który podpisują audytor wiodący i armator lub przedstawiciel armatora, którym może być kapitan statku lub inna upoważniona osoba. Raport zawiera plan audytu oraz wnioski z audytu w postaci obserwacji, stwierdzonych niezgodności i dużych niezgodności z wymaganiami Kodeksu ISM.

Obowiązki kapitana statku w przypadku inspekcji państwa portu

W przypadku zatrzymania w obcym porcie statku o polskiej przynależności przez inspekcję państwa portu kapitan statku jest obowiązany niezwłocznie przekazać informację o tym fakcie dyrektorowi urzędu morskiego właściwemu dla portu macierzystego statku zgodnie z art. 30 ust. 1 pkt 1 ustawy z dnia 18 sierpnia 2011 r. o bezpieczeństwie morskim (Dz. U. z 2025 r., poz. 883 - t.j.). Armator statku jest obowiązany dostosować statek do wymogów umów międzynarodowych, w szczególności w zakresie stwierdzonych uchybień, oraz opracować plan działań naprawczych i kontrolnych wraz z harmonogramem wdrożenia tych działań na okres 12 miesięcy.

Artykuł 41 ust. 2 ustawy o bezpieczeństwie morskim przewiduje, że armator, kapitan lub przedstawiciel kapitana statku podlegającego inspekcji rozszerzonej przekazuje organowi inspekcyjnemu przynajmniej na trzy dni przed spodziewanym zawinięciem do portu szereg informacji dotyczących m.in. identyfikacji statku, planowanego czasu postoju i planowanych operacji. Armator lub kapitan statku podlegającego inspekcji rozszerzonej zapewnia, aby w harmonogramie eksploatacyjnym statku przewidziany został czas wystarczający na przeprowadzenie tej inspekcji zgodnie z art. 41 ust. 4 ustawy. 

Aspekt ochrony żeglugi i portów morskich

Obowiązki kapitana statku nie kończą się na bezpieczeństwie technicznym. Równie istotna jest warstwa ochrony (security) wynikająca z reżimu ISPS (International Ship and Port Facility Security Code) i ustawy z dnia 4 września 2008 r. o ochronie żeglugi i portów morskich (Dz. U. z 2024 r., poz. 597 - t.j.). Artykuł 8 ust. 2 tej ustawy przewiduje obowiązek informowania regionalnego punktu kontaktowego o zdarzeniach i przesłankach mogących wpływać na ochronę statku, w tym tych mogących wpływać na zmianę poziomu ochrony. Natomiast artykuł 9 ust. 3 stanowi, że w razie utraty lub zniszczenia zapisu historii statku (CSR - Continuous Synopsis Record) armator lub kapitan ma obowiązek pisemnego powiadomienia dyrektora urzędu morskiego właściwego dla portu macierzystego, dołączając listę utraconych lub zniszczonych dokumentów. 

Praktyczna "checklista" dla kapitana statku związana z przyjęciem statku i sprawowania czynności służbowych

W celu wykazania dochowania należytej staranności przez kapitana statku w rozumieniu przepisów kodeksu morskiego - art. 56–57 k.m., kapitan statku powinien zapewnić:

  • aktualność dokumentów i certyfikatów oraz własną ocenę zdatności, nie opierając się wyłącznie na dokumentach,
  • realną obsadę i kwalifikacje załogi oraz nadzór nad wykonywaniem zadań,
  • dyscyplinę dokumentacyjną: protokoły inspekcji, realizację poleceń, raporty z audytów, ścieżkę działań korygujących,
  • gotowość na inspekcje, w tym rozszerzone, i terminowe przekazywanie wymaganych informacji,
  • procedury security/ISPS: komunikację z regionalnym punktem kontaktowym, ochronę dokumentów i reagowanie na incydenty.
